| dc.description.abstract | Satım akdinde satıma konu olan malın miktarı genelde akitte belirtilir. Ancak bazen malın miktarının akitten sonra akitte belirtilenden daha fazla olduğu görülebilir. Bu durumda ortaya çıkan ziyade miktarın fıkhî hükmünün bilinmesi gerekir. Aksi takdirde taraflar nizaya ve tartışmaya düşer. Bu makalede toptan fiyatlı mallarda akitten sonra ortaya çıkan ziyade miktarın fıkhî hükmü ve akde tesiri ele alınmaktadır. Bu vesile ile tarafların böyle bir durumda nizaya düşmemesi, satım akitlerinden sonra ortaya çıkabilecek maldaki ziyade miktarlar konusunda müşteri ve satıcının daha dikkatli olması ve akit beyanına bununla ilgili açıklamaların eklenmesinin sağlanması hedeflenmektedir. Bu kazanımlar da sağlıklı akitlerin yapılmasına ve iktisadi istikrara gereken faydayı temin edecektir. Makalede öncelikle dokümantasyon yöntemi izlenerek kaynaklara ulaşılmış, bu kaynaklardaki görüşler ve delilleri tahlil edilip tüme varım ve tümdengelim yöntemleriyle fıkhî hükümler tespit edilmiştir. Satım akdinin; ziyade miktarın asıl ve vasıf olmasına göre bâtıl, fâsit, sahih, lâzım ve gayri lâzım gibi farklı hükümlere sahip olabildiği sonucuna ulaşılmıştır | |
| dc.description.abstract | In a contract of sale, the quantity of the goods is usually specified in the contract. However, sometimes it may be seen that the quantity of the goods is more after the contract than what was stated in the contract. In this case, it is necessary to know the jurisprudential ruling of the excess amount. Otherwise, the parties will fall into disputes and arguments. This article discusses the jurisprudential ruling of the excess amount that occurs after the contract and its effect on the contract. In this way, it is aimed to prevent the parties from falling into disputes in such a situation, to ensure that the customer and the seller are more careful about the excess amounts in the goods that may arise after the sales contracts, and to ensure that explanations about it are included in the contract declaration. These achievements will provide the necessary benefits for the conclusion of sound contracts and economic stability. In the article, first of all, the documentation method was followed to access the sources, the opinions and evidences in these sources were analyzed, and the fiqh rulings were determined by inductive and deductive methods. As a result, the contract of sale can have the injunction of valid, invalid, void, binding and revocable according to whether the extra amount is original and quality. | |
